Sound scholarship: At Abbott & Associcates we take great pride in doing
careful research. That doesn't mean we are always right, because no one can
guarantee that, but it does mean that we will do our very best to study the
statutes and read and analyze the cases so that we give you sound advice right
from the start. This will make it less likely that you will pursue a course that
is doomed to failure from the start and needlessly incur legal fees on a losing
cause, and it makes it more likely that you will achieve a satisfactory result
in matters we pursue.

Good judgment: The lawyers of Abbott & Associcates have thirty-eight years
of combined legal experience. Mr. Abbott has owned and operated many
businesses, and has been involved in real estate development and investment
activities. In the field of direct marketing he has twenty years of hands-on
experience creating products, writing advertising, and in product fulfillment.
He serves as a business and legal consultant to companies all over the United
States. Based upon academics and years of business, real estate, investment and
marketing experience, we feel we can supplement our legal expertise with sound

A sound work ethic: It is often said of lawyers that the key to success
is not inspiration, but perspiration. If there is one most important key to
winning cases, it is hard work. We pride ourselves on being physically
tough. If we have to work sixteen to twenty-hour days, we know we can do that,
because we often do it.

Availability: We believe you are entitled to a lawyer whose home-phone is
listed in the telephone book and who will not be angry if you call at night or
on a weekend. Obviously, we need a life too, but our clients are our friends. As
friends, we find they are considerate of our time and privacy. When you call us
at home that means you are troubled by something and need an immediate answer.
If you are worried about something, we would much rather have you call us at
home, ask some questions and put your mind at ease so you can go on to have an
enjoyable weekend and sleep well. No lawyer at Abbott & Associcates will ever be
angry over a call at home. Rather than have you ruin your whole weekend fretting
over a problem, it is little enough for us to take a few minutes of time to put
your mind at ease. Any friend would do the same.

Friendliness: We take pride in maintaining a friendly office where you
can feel comfortable and at ease. Everyone likes a tough lawyer, and we believe
we are tough lawyers. But that doesn't mean we can't smile a little and be
pleasant with our own clients. We don't particularly like stuffiness, and we
want our clients to be comfortable coming into the office just as they are. On
some days you may even find us in casual clothes too.

Honesty: Most lawyers are honest, and we want to be among them. Honesty
involves a number of things. It means making an honest assessment of a case
before encouraging a client to proceed with it. We feel very nervous when we
handle litigation on an hourly basis. If we lose, no matter how hard we try or
how good the quality of our represention, the client is bound to feel bad and
not likely to give us a referral. Not long ago a man visited our office and
announced that he wanted us to file a lawsuit for him and said he would pay an
hourly fee, win, lose or draw. After we looked into his matter, we felt he had a
losing case, and we managed to convince him that he should not pursue it. We
charged him less than $100 for the advice, and talked him out of paying many
times that amount in legal fees to pursue a hopeless venture. When he left our
offices, he enthusiastically exclaimed, "I'm going to tell everyone I know
that I have found some honest lawyers!" Honesty is not just an unselfish
exercise. It is the key to success.
Honesty also means fair billing practices. It means scaling a case down and
handling it efficiently when the amount involved does not merit a lot of time or
expense. It means staying within budget. It means handling matters efficiently
and charging less than quoted when the commitment of time is less than expected.

Ethical representation: The rules of professional conduct require that
attorneys be honest with the courts. While we have absolutely no qualms about
representing people who may have made mistakes or violated the law before they
came to us, we do not wish to be involved in presenting fraudulent claims or
misrepresenting the facts or the law to the court. In the personal injury field,
for example, we recommend doctors who are unbiased toward either plaintiffs or
defendants, and who will assess injuries just as they are. When we present
medical records to insurance companies, we present all the records we have,
whether they help us or hurt us. We believe that the increased credibility that
gives us with the insurance adjusters with whom we deal on a regular basis
results in larger settlements for our clients, and a greater percentage of
settlements out of court. We believe that if we always approach judges with
candor they will respect us and believe us, and in the long run that will
benefit our clients. We always instruct our clients to tell the truth. If you
are ever confronted with a lawyer who asks you to do something that is not
honest, you should be very wary, because a lawyer who is not honest with
insurance companies or with judges may not be honest with his or her clients
either.

Minimizing legal fees and costs: Our philosophy is that we are "problem
solvers." Than means we should take big problems and make them into little
problems. To the extent that we can resolve your case with a minimum of time and
expense, do it quickly, keep you out of court whereever possible, and achieve
the result you want, you will be a most happy client who will refer others to us.
We firmly believe that the less money we can charge you on a given case, the
more we will earn in the long run. Why? Because the way you define success is,
to solve a problem with a great result, a minimum of fuss and the least expense.
If that is your definition of success, it has to be ours too. If we give you "success,"
on your terms, you'll brag about us to your friends. It also enhances the image
of the legal profession. It's called win/win.

Negotiating skills: Some people erroneously believe that in seeking out a
lawyer they should find a "pit bull." That is not true. Pit bulls are
vicious dogs that are out of control. In negotiating settlements a "cooperative
negotiator," who is skilled, a good listener, friendly, and always in
control, will generally accomplish much more at the bargaining table than a
combative, irritable "aggressive negotiator" whom no one likes. Juries
sense it too, and in front of a jury nice guys truly do finish first. There is a
place, however, for a display of righteous outrage and even a little yelling and
screaming. An aggressive negotiator will walk all over you at a bargaining table
if you don't meet him or her with equal intensity. The best lawyer is one who is
genuinely a nice person, but who can be firm and tough when necessary, and
always be in control of his or her emotions.

Relief of stress: Going to a lawyer is not a pleasant experience. It is
like going to the dentist. You go to a dentist when you have a sick tooth. You
go to a lawyer when you have a problem you can't resolve on your own. Sometimes
those problems are very stressful, at least until they are resolved. We care
about you, and would like to relieve the stress as much as we can. Let us
shoulder your burdens, and do the worrying for you. We believe that is a very
important part of our job.

Keeping you informed: We do a number of things to try to keep you
informed about what is going on with your matter. Obviously, we can't call every
client every day, or we'd never have time to get the work done. But, to make up
for that, we send you copies of correspondence and documents so that you'll know
what we are doing for you. All billings are fully itemized so that our clients
are fully informed as to the basis for our fees.
One reason we do that is to try to keep our clients informed so they do not need
to call in just to ask us what is going on. Lawyers are notorious for not
returning calls promptly, and to fully understand why that is sometimes true you
need to understand what goes on in a law office. A lawyer can get twenty or
thirty phone calls in a day. Sometimes they come when the lawyer is in
conference with a client, taking a deposition, in court, or fighting a filing
deadline. Under those circumstances it is impossible for the lawyer to speak
with you without jeopardizing another client's matter.
If you call in, we have competent staff members who can answer some of your
questions. If we can't, and we are in our office and not on another phone call,
we are delighted to speak with you and answer your questions. If we are out of
the office, in court, or fighting a filing deadline, we try very hard to call
you back just as quickly as possible. If you don't receive a prompt call-back it
may be because we are playing "telephone tag," and we invite you to
call us again so your questions can be answered promptly.

Technology. Abbott & Associcates employs the latest in computer technology.
Our networked computer system allows all attorneys and staff members instant
access to all documents and research that have been generated in every case we
have handled. Dictation is accomplished by state-of-the-art equipment, linked
with our computers, that permits direct and instantaneous digital transmission
of dictation to the secretarial staff, thus eliminating delays in transcription
caused by reliance on old-fashioned tapes. Much of our law library is on CD Rom,
allowing word-searches for the law and eliminating the time-consuming process of
having to search through printed indexes in printed texts. Through Westlaw we
have the ability to access, on-line, federal laws and statutory and case-law of
every state. The purpose of it all is to be able to take advantage of past work-product
and research, improve the speed and thoroughness of our research, and at the
same time reduce the time it takes to get the job done. This benefits our
clients not only by improving the quality of our representation, but by reducing
fees.
