What Is A Class Action Lawsuit

A class action lawsuit is like other lawsuits in that it is filed in either State or Federal court.  Most lawsuits are filed by one or more plaintiffs against one or more defendants.  Class action lawsuits are different because one plaintiff files the lawsuit on behalf of a class of similarly situated individuals.  For example, we filed the first class action lawsuit in the State of Utah against American Home Products for injuries caused by Fen-Phen.  (click here for information about current drug injury cases we are accepting). At that time, we didn't know the names of all the people who had been hurt.  We did know that a lot of people had taken Fen-Phen and that a lot of those people were hurt.  So we filed a class action lawsuit on behalf of all those people in Utah who had taken Fen-Phen and who had been hurt.

Why File A Class Action Lawsuit

Class action lawsuits serve several beneficial purposes.  First, and foremost, they allow people to pursue claims that might not otherwise be financially viable.  For example, we filed a class action lawsuit against Omniture and Adobe to either stop the merger or to require a higher share price.  (click here for additional information about merger and acquisition lawsuits). The cost of pursuing such a lawsuit is enormously expensive.  At the same time, each shareholder stood to gain only a few extra dollars per share.  If someone owned only one share, that shareholder could not afford to hire lawyers to represent her.  A class action allowed the shareholders to pool their resources and make the lawsuit financially viable.  Another reason that Class Action lawsuits are helpful is that they preserve the statute of limitations for people who might not have otherwise acted on time.

Some Unique Challenges with Class Action Lawsuits

While class action lawsuits serve many valuable purposes, they have their unique challenges.  One of the biggest challenges is that we must get approval from the court to certify the class.  This is not always as easy as it might seem.  The defendants do not like class action lawsuits because they realize it will bring justice to many more people.  For that reason, they typically fight certification vehemently.  Our experienced Utah lawyers know how to get that certification.  Another unique challenge with class action lawsuits is that the defendants typically try to get the lawsuits transferred to another State and find a judge that will be more sympathetic to them.  Carefully crafting the class action lawsuit in the first place can limit their ability to do that.
